USCIS Conducts Second Lottery of FY2022 H-1B Cap Registrations

In July 28, 2021, the U.S. Citizenship and Immigration Services (USCIS) issued results of a second lottery of H-1B registrations conducted due to insufficient numbers needed to reach the annual quota of 85,000 new H-1Bs (the “cap”) for Fiscal Year 2022 (FY2022). Although official figures have not yet been released, we estimate that the overall acceptance rate in the second lottery is about 8%, compared to approximately 5% in last year’s second lottery. Registrants selected in the second lottery will be eligible to have H-1B cap petitions filed on their behalf between August 2 and November 3, 2021. We have already notified our clients of all newly selected registrants. While it is possible that the USCIS will select additional registrants for FY2022, we believe that this is fairly unlikely.
