Premium Processing Reinstated for Cap-Subject “Lottery” H-1B Petitions

On Monday, September 18, 2017, the United States Citizenship and Immigration Services (“USCIS”) announced that it is reinstating premium processing for cap-subject H-1B petitions. We will notify our clients of all pending cap petitions that are eligible for premium processing upgrades over the next few days.

Please note that premium processing for H-1B extension of stay and change of employer petitions is still not available. In recent discussions with the American Immigration Lawyers Association (“AILA”), the USCIS has indicated that it anticipates premium processing to resume for all types of H-1B petitions by October 3, 2017. We will provide more information once it becomes available.
