Department of Labor Resumes Processing of Prevailing Wage and Labor Certification Applications

The U.S. Department of Labor (DOL) announced that the Office of Foreign Labor Certification (OFLC) has resumed processing of employer requests for labor condition applications (LCAs), prevailing wage requests, and PERM labor certifications for both temporary and permanent employment-based petitions. The Foreign Labor Application Gateway (FLAG) system is now fully operational, allowing users to submit new applications and access pending cases.


What This Means for Our Clients

Employers may now move forward with immigration processes that rely on DOL certification. Specifically:

  • Temporary Employment Programs: The restored FLAG system allows filing new LCAs and processing pending LCAs for H-1B, E-3, and H-1B1 specialty occupation petitions.

  • Permanent Employment Sponsorship: Clients can file new PERM Labor Certification applications, request prevailing wage determinations, and continue processing pending PERM and prevailing wage cases.

Goeschl Law Corporation will be filing OFLC applications for our clients that we were not able to submit due to the shutdown as quickly as possible over the next few days. In some cases, we may be reaching out to clients to confirm information needed to finalize the submission.
