USCIS Announces Implementation of H-1B Electronic Registration Process for Fiscal Year 2021 Cap Seas

Today, December 6th, the U.S. Citizenship and Immigration Services (“USCIS”) announced that it will be implementing the electronic pre-registration process in the next H-1B lottery. As noted in our recent H-1B Cap Season Reminder alert, employers will be required to “pre-file” an electronic registration through the USCIS online portal and pay the associated $10 H-1B registration for each employee or prospective employee it wishes to sponsor for a cap-subject H-1B in order to be considered in the lottery for the coming cap filing season in April 2020. The electronic registrations will need to be submitted during the designated registration period from March 1 through March 20, 2020. If more registrations are received than available H-1B slots, which is expected, the USCIS will conduct a random selection process, or lottery, to determine which registrations are accepted. Only those petitions selected in the registration process will be eligible to file a complete H-1B petition during the filing season. The USCIS will post more information on its website regarding the registration process, along with key dates and timelines as the initial registration period nears. The Department of Homeland Security (“DHS”) intends to publish a notice in the Federal Register in the coming weeks to formally announce implementation of the H-1B registration system and provide additional details on the process.
