USCIS Resumes Premium Processing for All H-1B Petitions

The USCIS announced today that it will resume premium processing for all H-1B petitions starting tomorrow, Tuesday, March 12. As previously reported, the USCIS had suspended premium processing for H-1B change of employer, new employment and amendment petitions in September of last year. Earlier this year, the Service partially resumed premium processing for petitions still pending from last year’s H-1B cap lottery, and change of employer petitions that were filed before December 21, 2018.  Today’s announcement resumes premium processing for all H-1B petitions.  Although the announcement does not specifically mention the availability of premium processing for H-1B petitions to be filed in this year’s H-1B cap lottery, such petitions are presumably included within the scope of the announcement.

 

What this means for our clients?

 

Over the next couple days, we will be reaching out to our clients to confirm whether they wish to interfile requests for premium processing for H-1B petitions that are currently pending with the USCIS.  We will also confirm whether our clients wish to file premium processing for change of employer new petitions going forward, and petitions to be filed in the H-1B cap lottery.
