National Interest Waivers

The National Interest Waiver ("NIW") program allows select foreign nationals who qualify for EB-2 classification (by either possessing a Master’s degree or meeting the standard for an "Alien of Exceptional Ability") to avoid the labor certification process where it is shown that their work in the United States benefits the nation’s interest. As with the Aliens of Extraordinary Ability, the NIW program does not require an employer sponsor, and can thus be filed by the foreign national on his or her own behalf. Although the NIW standard is quite high, for persons with exceptional qualifications who are working in industries commonly regarding as benefiting America as a whole, a NIW petition should be considered. Recently, we have successfully prepared NIW petitions for persons working in the fields of medicine, medical device technologies, and drug discovery.
